Securing your Legacy & Drafting your Estate Plan
We know you work hard for your family and continued growth of your assets, so knowing that you have helped secure your family with financial security can certainly bring you comfort. We thoroughly analyze your holdings and strategize the best estate plan to meet your goals, whether that be to minimize taxes, avoid probate administration, establish care and guardianship for your children or for your pets, or support philanthropic causes.
Your Last Will provides the opportunity to distribute your property, establish care for your children and otherwise express your wishes upon your death. If you die without a Will, the probate court determines how your property is distributed, who cares for your children and even what happens to your beloved pet — making decisions that might not reflect your desires. A valid Last Will ensures your intentions are honored. If you have minor children, your Will allows you to make decisions about their future care. This is especially crucial if you are a single parent or if both parents die in a common incident. If you do not name a guardian, the court will appoint a guardian for your children and may make decisions adverse to your ultimate parenting goals. You can also make arrangements for your pets’ care in your will, including naming a guardian to take responsibility for your pets.
For a more secure plan during your lifetime, a revocable Trust can provide added estate planning benefits for your assets, including probate avoidance and estate tax savings for married couples. Glynn Law Offices provides counsel with respect to trust funding, and will also prepare the necessary Deed to transfer any real estate into your Trust. We are familiar with many of our local financial institutions and banking centers, and review Assets and holdings with all clients to ensure beneficiary designations on your accounts, life insurance policies and retirement plans are up to date. We are available to work with you or your financial advisors to update any beneficiary designations to ensure they reflect your estate planning wishes.
Changing your Estate Plan
As your life changes, so might your estate plan. You may need to update your Will or Trust throughout your life. Glynn Law Offices drafts valid codicils and Trust Amendments that address changes in your financial situation, marital status, number of children, philanthropic interests and general lifestyle decisions.
Estate Administration and Probate Filings
For our clients who ultimately pass away, we provide support to the surviving spouse or other family members when it comes time to navigate the process of estate and trust administration. We will meet with the family and provide helpful instructions for gathering the financial information in order to determine whether there is a filing requirement for a MA estate tax return, or if a probate administration required. We then assist with the disposition of estate and trust property to the intended beneficiaries and formal closing of the estate. We work closely with our local financial institutions and banking centers, so our clients leave with properly updated beneficiary designations on any transferred accounts, life insurance policies and retirement plans. For clients who establish continuing trusts, we continue to work with their surviving family members with respect to such trust administration.
